I am military but not under orders. Am purchasing a house now but have a lease until mid year 2011. Is there any way to terminate early legally?

2006 Virginia Code § 55-248.21:1 deals with early termination of rentalagreement for military personal. Under this statute the lease can beterminated before the term if you , (I) have received permanent changeof station orders to depart 35 miles or more (radius) from the locationof the dwelling unit; (ii) have received temporary duty orders in excessof three months' duration to depart 35 miles or more (radius) from thelocation of the dwelling unit; (iii) are discharged or released fromactive duty with the armed forces of the United States or from hisfull-time duty or technician status with the National Guard; or (iv)ordered to report to government-supplied quarters resulting in theforfeiture of basic allowance for quarters. Unless and until you areterminating for the aforementioned reasons you cannot opt for an earlytermination and protection under SCRA . It is always an option to have adiscussion with the landlord to reach an amicable way to resolve thisissue without much loss to either parties.

I'm told that in some states when a new owner takes over the current leases must sign a new lease with the new owner because the tenants did not sign the lease their current lease with the new owner, but the old owner. It seems that the leases automatically come to term if that is the case.
It so happens that I need to terminate my "old" lease early. Under this situation, can I not switch to a month to month lease agreement and thereby avoid the two month penalty? |
