Hi, if anyone can help me with this question I'd REALLY appreciate it!
My boyfriend and I recently signed a lease for a town house and paid the landlord a security deposit of $3,000. After thinking it over and discovering that we really could not afford the place afterall, we called the landlord within 24 hours to cancel. We had both signed the lease already, however the landlord had NOT signed. (She still needed to call our employment companies to verify our jobs and income). Therefore since she had not officially 'accepted' us (because she was still doing background checks) it could be argued that no lease had taken effect yet. The landlord states that she has a legal right to keep our security deposit now and NOT let us move in. Is this true? Please help! |

You may sue in small claims. If she had not accepted you at that point then no agreement existed you may argue. And no damages to her really really exist.
