Hello, I rented a mobile home in a respectable mobile home community in Florida from a private owner. Initially, the agreement was for $500 per month on a "month to month" basis. A security deposit was provided in the amount of $500. The owner is in Pennsylvania during all of this. After the second day of being there, the central AC unit failed. After "penny pinching" for nine days, and my living in temperatures of 100 - 110 in the house for this time, the landlord paid for an inexpensive unit to be installed. After this time, we negotiated that my rent for the current month (June-July) and subsequent months would be $400 for my inconvenience. A few days later, there was a plumbing problem in the bathroom. The landlord "cried poverty" - I decided to fix it myself, not asking to be reimbursed. Days later, the water heater failed and water was gushing all over the place. Since the community paid for water, the water main valve to the house obviously had to be turned off. So, no water. About 6 days were left of the current month. The landlord informed me that she could not afford it and that I would have to go find another place. I informed her that I wanted my $500 deposit back plus the $100 overpayment for my month's rent (I initially paid $500) plus compensation for 6 days of the place not being fit to live in, the amount being $80, prorated. Recently, I sent an email message to her and a phone call asking within what time frame I could expect the funds. She fails to give me the courtesy of a response. The $680 is owed to me without question. What can I do? |

I wish to inform you that the terms decided between the parties as to contract are the terms which are enforceable. In the regard, the landlord has to agree with your rental agreement and you may claim amount of security as well as over payment of rent. Florida Statutes Section 83.49 provides that the landlord should return deposit within 15 days. In this, you may inform the landlord that if you are not given the amount due to you then you will take legal action.
