hi, i live in toronto ontario canada.
i recently rented a house . the landlord asked that i pay 3 months rent and would therefore have to give him 60 days notice in leaving, and that he would give me a copy of the lease. he promised to clean up the exterior of the house and replace the stove and fridge. due to our arrangement i paid him first and last but i did not pay the 'second last' month rent because i found out legally he cannot ask me for it. we have had contact but he never asked me for the other month or mentioned the copy of the lease. he has been very nice and easy to get a long with he replaced the stove and fridge but did not clean up the junk that is still outside from the renovations. it has now been a month basically since i am living here and i am second thinking the place for many reasons. mainly because i only rented a house so my son could have a yard however because of the condition of the yard i cannot even let him out to play, and because the downstairs tenants seem to be smoking in the house, i do not know if the landlord knows that but being pregnant an havin a 4 year old it bothers me when it comes through the vent because i am not a smoker. as i said i do get a long with the landlord other than these issues and i do not want to leave him stranded or cause hard feelings; however i have to do whats best for me and my kids. is there any way i can break this lease without causing too many problems ?..i have been looking for people who want to rent so that i can either sublease or at least give the landlord a new tenant so i can leave as soon as possible!!!!!!!!!!!! (I DONT EVEN HAVE A COPY OF THE LEASE) HELP!! |

It is permitted to break the lease (or sue for the decreased lease value in small claims) if they have failed to comply with the lease and/or there are health, noise or safety concerns--but save all information, evidence etc. in case they dispute the situation and try to take you to small claims court.

yes i know that part but what about the extra month deposit i agreed to ..he is not being reasonable considering this is illegal to ask me for more than last month rent. i appreciate your response however you did not answer my actual question..please can somebody give me a more specific answer
