First of all let me tell you as a tenant it is your duty to pay the rent in time. Default in rent will give Landlord to initiate eviction proceedings. But in order to evict a tenant Landlord has to follow legal steps. Here, landlord is harassing you by telephoning that too in midnight. Landlord can remind you about rent but that should be followed during day time. As a tenant you are paying rent to your landlord, so you have the right to tell him to stop calling during night time. If it continues even after your warning, then you can complain about this to the concerned authorities. New York Landlord tenant Laws specifically dealing with Landlord and Tenant relations.

The obvious question would be: why, if you have caller I.D. and you know who it is, don't you simply answer the telephone?
There really isn't any law that states when a landlord can call a tenant. You are late with the rent and it's evident (for obvious and sensible reasons) that he wants his rent money. Why you don't pick up the phone and resolve the issue is the true question here. You wouldn't be being "bothered" if you simply pay your rent on time and communicate with your landlord. Stop acting like a child and face him. Lexus, whatever your day job is, stick to it. Your knowledge of the law is egregiously insufficient. |

I agree with LEXUS regarding questioning the "unregistered" responder. Being that I am too an unregistered responder I can say without prejudice that you responding to the concerned Tenant in the way you did shows you must be either A) One of many Slumlords in our Country who will find their abilities to collect rent in the future greatly constricted and or B) Just a subjective person with no regard for those who struggle with "harsh realities" of simply existing in life. It is very difficult working so hard and living to Pay 70% of your income to a unscrupulous Landlord every month who fails to see how fortunate they are. Soon Landlords will find that their abilities to harass their Tenants whenever and for whatever will be greatly constricted and it has already started in our city of Toronto, Ontario, Canada.
Finally, I do realize that there are bad people on both sides and most likely I more problem makers on the Tenant side of things if there ever were to be a 100% objective, honest and accurate way to measure such a grey area question. I can tell you that many municipalities have already moved towards making it a little bit unfair for landlords but this is due to the simple statistics game where there are becoming more low and middle low income individuals and families and their levels of education amongst them are significantly greater as well. In the future, It will become this simple, if you are a landlord, you will act in a professional, diplomatic, fair and scrupulous manner, exactly like a business must or Tenants will have the right to withhold your rent payments legally under very specific, certain, and fair logistical circumstances. |

For all you people calling the late rent payers idiots or any other name you can think of...I am a single mother of 6 children. I do not collect any help from the state and I do work 10 hour shifts!!! I take offense to who the hell you think you are talking to us like this. Yes, I go through the same thing with my landlord. She calls non stop at all hours of the night. Even has her husband ringing my door at 12:30am. I do tell her rent is going to be late we even made an agreement that I would automatically pay the late fee every month. I am struggling but I do pay my rent and I don't ask anyone for anything. Although, my landlord still calls numerous times on a daily basis and she is NOT the nicest person to deal with. I am getting sick with anxiety when I see her number show up on my caller ID. I am trying to raise my children and do not need the harrassement from her. Like I said...we came to an agreement and I would call her when I have the rent. I have never went past a month paying rent and it has always been paid within the month. So all you better than thou, prissy ass people who have those good jobs...upper class looking down on the lower class even though I work and struggle to make ends meet. Let me tell you...I have more riches in my morals and values than you own in any amount of money!!!

I was getting ready to move into an apt, n the LL asked for first, last, and security. Two days b4 I was to give her deposit she asked for anther months security.... I sd fine, n I gave the 4 mths deposit. I moved in on the 17th of December, so I asked her how we are going to do the rent, bcuz its due on the first. She sd I will give u the 2 weeks for free n the rent will be due on the 1st of Feb. I told her that I wld pay her half of the rent on the first of Jan, bcuz I want to pay my way. So the 29th of Dec., she calls n says when will u be able to give me that money. I told her I wld have it in the morning (don't forget this is money that I sd I wld give her its not in my lease) so the next morning I seen the guy that lives downstairs n he sd the LL called him bcuz she was here n the rent wasn't on the ledge in the front hallway. So I called her to find out why she is talkin about me to another "tenant" (he doesn't pay rent) n she sd she didn't want to call me about the money but she is used to pickin up the rent from there @ 7 am. I told her she cld come right then. From then on the rent was always left the day before the 1st NEVER LATE! Well Wed. The 1st she called my phone @ 4:30 AM I missed the intial call n I called her back @ 5 AM n she sd " I was just wondering if the rent is there I want to come get it now" So she gets the rent and calls me yesterday n says " Can u give me 500.00 of the rent for Sept on Aug. 15th and pay the balance on the 1st, n I will give u Dec.'s rent for free" Is this considered harrassment?
