Evicting a tenant- What about the Security Deposit?

I am in the process of Evicting a Tenant. Once she answers into court, we will have a court date where the judge will determine how much is owed to me and when the tenant has to move out by.

The tenant owes 3 months worth of rent. She paid a security deposit in the beginning of the lease. If I do not know what damages have occured in the condo since she still lives there, should I get the condo checked for damages and get an invoice for damages before we have to go to court ? Or do I explain to the judge that I cannot give the security deposit until I can check the condo after she moves out?

Am I liable to give the security deposit back even if I'm having to evict her?

You should give notice and check the status and condition now. You will be able to keep the deposit it would seem since she has not paid.
