We live in an upstairs apartment of an older home that hasn't been taken care of. Tennessee state codes officials have been out there and said that our landlord won't reply to their requests to bring the house up to codes. Then, we started smelling gas and found out our heater had a gas leak and was also dumping carbon monoxide and other toxins into our house. We finally got that fixed after 2 weeks in February without any heat!
Today, April 2nd, we received a certified letter that stated that we have to be out of the apartment by April 30th. No reason given, just a one sentence letter. Is this a legal notice?? I called the landlord and he said that his family is coming into town and he just needs a place for them to stay so he's kicking us out. That's only 29 days away that we have to be out, can he do that for no reason with that short notice? We signed our initial lease October 2005 and it was automatically renewed per the terms in the lease so it goes until October 2007. Can the landlord just break our lease for no reason and with no penalty? Does he owes us compensation because he is breaking it? Please help!!!!! |

No he cannot; the lease is valid! And he would lose in court.

If we offer to make an agreement with him to end the lease early, can we ask for compensation, such as increased rent costs for remainder of lease, moving costs, etc?

You can try...but he may not agree to that.
