Confused MA Laws

Hi,

I have a couple questions

(1) In MA is a landlord required to give 24 hours notice before entry of an apartment (without being an emergency) or can they enter at will without notice?

(2) Who has the right to have a key to my apartment? Should only the landlord and myself have a key and/or his the landlord authorized to be able to give to other family members, building management, ETC?

MA state statutes have no notice specified in the law prior to entry. It does say the LL can enter to inspect, to make repairs or improvements, to show the unit to prospective tenants and buyers, and in an emergency. If just doesn't list any notice requirement. There may be a local (city or county) ordinance - you would have to check. But there is no state requirement that they give you notice. The idea of a required 24 hour notice does not apply to all states.

The LL has the right to have a key to your unit. If he has a building manager or a maintenance department, it would be proper that they have a key to gain access in emergencies or to make repairs. Otherwise they would constantly be asking the LL for a key to one unit or another. I don't know why other family members would have a key unless the LL was planning to be away and unavailable for some period and they would act as his agent in his absence. All keys should be kept in secure locations. Preferably in locked areas or in locked boxes.
