Wink Recent knee disability need to move & break lease

My wife is having knee partial replacement on Dec. 14, 2009. We moved into apt. in Feb. 09. One year lease. We need to find more suitable apartment with no stairs, wife is in pain, bone on bone in knee, stairs are getting harder to maneuver. Can we break lease?

No you cannot. You can however discuss things with your Landlord to see what (if anything) can be done

Since here condition is to be remedied by surgery and is temporary, she doesn't qualify to break the lease under the Americans with Disabilities Act. I concur with sunlover. Talk to the LL. Maybe he can transfer you to a downstairs unit.
