When I moved into my apartment the complex offered free cable as an amenity included with your rent. They still advertize free cable. This week I received a letter stating the complex has decided to discontinue cable for the building. Can they do this without lowering our rent. They have raised our rent over $300.00 in the last 2 years. Cable is the only amenity we have. We are month to month. |

As a month to month tenant, they can change the terms of the agreement at any time by simply giving you the required amount of notice. As long as they give you 30 days notice of the change, yes, they can remove the cable. You will have to pay for your own cable. This is no longer guaranteed to you since you are no longer under lease.

The reason I mention this is that $300 in rent increases sounds excessive given the legal limitations under the LARSO. The ordinance allows only 4% increase per 12 month period as of this year (up from 3% prior to that). There are only a couple of exceptions that allow a higher increase, but depending on your original rent, the increase you mention still seems very high. I'd look into that if I were you to see if you weren't overcharged for rent increases since your tenancy began. |
