Default New LL having non payment issues with new tennant.

It's only been 2 week's and my cousin&girlfriend have not paid thier 1st full month's rent. So far they have paid a security deposit and 1/2 month's rent. Rent has not been paid for Sept,due the 1st.Unfortunatley he is family, but im not going to sit back and taken advantage of.He misled me on his income situation and ability to consistently pay rent, not to mention his girlfriend doing the same.I found out neither one has a working bank account, and now they are avoiding me. what rights do i have as a LL to terminate his lease and re rent my unit ??

Based on what you say here, you could file suit against them (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to their behavior...

Prior to filing any court case, I suggest that post or serve your state's required pay or quit notice. Please list your state. Each state has a required form to be served in the event of non-payment of rent. This form warns the tenant that further action will be taken and gives them a set amount of time to pay the rent. IF they fail to pay rent, then you may take further action which can include eviction or a suit in amall claims court.
