What should I do if my car is broken into while parked at my own building?
I live in Toronto, Ontario.
Between midnight and 8 AM of Weds July 15'09, my car was broken into while parked at the underground parking of my building and a hands-free device was stolen - the underground parking is closed but doesn't have a security cam. We wrote a letter to management complaining about it, asking them to take further actions to avoid these situations, and also letting them know that we were moving out by the end of Sept 2009 (in order to comply with the 60 days notice). Less than 10 days after - again between midnight and 8 AM of Friday July 24th - our car as well as six other cars parked where broken into and devices were stolen again. We have not received any notice from management and have not seen any actions taken. Given the above, we feel unsafe and at risk living here, thus want to move out by the end of August'09 at the latest, but we acknowledge the 60 days notice required as per our contract. I thought about not paying August rent, but have them use my initial deposit... but I'm not sure if they can take any legal actions against us for moving out with a 30 days period notice. Can you provide any advice? Your help is much appreciated. Thanks, |

1. Crime in the area is not a legal reason to break a lease. The crime is not management's problem or fault. Call the police. You park your car at your own risk anywhere. There is no guarantee of safety, even in your own home.
2. If your lease has not expired, expect to have consequences for breaking the lease (owe rent until re-rented, advertising fees, agent fees if they use one to find a new tenant, etc.) You must abide by the notice requirements in the lease. 3. You cannot use a deposit as rent. If you fail to pay rent, you will receive a Pay or Quit notice, then an eviction suit once it expires. 4. Pay your rent. Wait out the end of the lease. Give the required amount of notice to vacate. Check out the crime in the neighborhood of any new place you consider before you sign a lease. |
