Default Family Matter Eviction

My father owns the house I am living in. I have been living with an abusive women for four years. She is still legally married to another man, therefore, I have been told by a lawyer that in the State of Colorado we cannot be considered a common law marriage. I have been trying for about a year now to break up with this women and have asked her to move out of the house. She refuses to do so. I end up having to spend the night away from the home my father has given me permission to live in many times. I actually manage three other rental homes for my father. Can I post a Notice to Quit on the grounds that the occupant does not have a lease and the owner of the home (my Father) has not given the occupant permission to live in the house?

You say you manage other rentals for your Father. Do you manage this one? If not then the "Notice to vacate" must come from him.

If you had a lease with your father to live there, you would be the master tenant and she your subtenant. You could serve her. But I doubt you have one.

Therefore, your father needs to give her a 10 day notice to vacate. No reason is needed for a month to month tenant or occupant. But it must be in writing and delivered to her. If she fails to leave by the end of the notice, he needs to evict her.
