Default Should I leave?

I moved into my apt in Feb 06'. By June 1 of 2009, I had not been late on any rent payments. Rent is due on the first of every month. I have until the fifth to get it paid. I told the assistant manager on June 5 that I would be late on my rent. The assistant manager told me that he/she would have to speak to their manager. Earlier that day One of the LL came to my home and look at how many problems I had and told me by Friday June 12, that I would have some answers on when things that be fixed. June 8, my daughter birthday. I planned a party. I did not plan to have not my rent money. Just happen. I will never do it again. I went To the Rent office to talk with the manager; the manager told me that the LL Company was not going to give any more extensions out. The manager told me those where the rules of the LL, and that I need to connect them. I called my mother. I wanted my mother to know, for one, that I had never been late on my rent, and that they would not give me an extension. She was mad at me, for begin late on my rent. In addition, we know the manager. She went over with me to tell the asst manager and the manager that we were in a recession and that I need a little help. They suggested call the LL to see if I could get an extension. My mother begged. They said no, but that, I was taken things too personal. The manager said, “This is just business.” We left. My mother was talking very loudly to me. My mother said, “Move because this is not a safe place for your children. I have a disable child. She has holoprosencphaly. She also said that the apartments were messed up any way. So after, we left. I started my daughter’s party. I was a wreck. I called and called, but I could not get in touch with the LL. The manager told me, one of the LL would be in town on Thursday, June 11. Therefore, June 11 the assistant manager came to my home and told me that almost everyone in these apartments was going to be late. The assistant manager said, “The LL wants to know when I would be able to pay my rent.” Remember, I am scared at this point. I told assistant manager that 20 June I would have rent… Now look up, what day this is on in your date book...lol it is a Saturday. Who pays rent on Sat? The assistant manager wrote down that I would pay it on the 20th. In addition, the assistant manager said, A little later I need to come by the rent office. SO I said ok. A few hours after that on 11 June, the manager came by and told me that the LL wanted to speak with me. I went to the Rent office and the asst. manager, manager, one of the LL and another person were there. The LL asked me how I was doing. I told the LL my stomach hurts. TThe LL asked me, “What was the problem with me not having my rent?” I told the LL, “I just did not have it.” I got behind this month. The LL went into how do I feed my children, and how do I pay my car note. I Said I do not have a car note. THE LL finally got finish asking me questions, and told me that I need to get my SH! T OUT OR HE/SHE WAS GOING TO GET MY SH!T OUT. Omg. I freaked. I exited the doors and called the police. The police could not really do anything. They said do not go back to THE OFFICE (Uhhhh I have to pay my rent. Lol), they told me to come in and file for chargers… I did. Also at my apt, it was inspection day. After all this happen they cont. with their business. They did not inspect my home. I went to the store. Once I got home, my CHILDREN DAD told me that, the manager came by, and that I need to come to the office to sign the agreement to pay rent by June 20. I went back to the office. After I finish it was about 445pm, so they decide, after I signed the note, to inspect my home. When they came in, I SHOWED them the problem in my bathroom, that I had also SHOW the other LL, which told me I would get answers by June 12. Today is June 11, the day they inspected my home, cussed me out, and come over to play nice person with me. Once they saw the problem, the LL that cussed me out said, “that I need to be moved ASAP.” I was happy about that part. Nevertheless, the LL is not here, AT all times. The manager is. The manager could have had someone already set up for the apt, that the LL said I would get. (I felted as if things would not workout.)On June 15 I called the manager, but as I was going to tell her that I had the rent, THE MANAGER went into to, Did I file charger on the LL that cussed me out? I said yes. THE MANAGER said THE COMPANY did not know if I would get a new apt. (As I knew THEY would say.) I said why, THE MANAGER said THEY could not give an apt to anyone that had file chargers on THE LL. I said should I drop the chargers. THE MANAGER said yes. I said ok, I will. THE MANAGER said talk to the LL. I said ok. ON 16 June, I called the LL Company. I spoke with the LL that came to my home FIRST, and THAT told me that,” things would be handled by June 12.” THE LL said I did not need to move. THIS LL said that he/SHE did not understand the problem that is going on with me and the other company members, but do not worry about them, that things would be taken care of. THIS LL asked me why I want to move. I said because I was scared that I wasn’t going to get an new apt, OR PUT OUT and that I would have to move during a time that I really didn’t have the money to move, so I wanted to move right than and pay my rent to the day I leave. I wanted nothing more in return from the company. (Meaning I did not have the money to move at any other time, but at that moment if they made me move, I could MOVE. I sold my truck to get sum extra cash. So I could move. If they hit me with a paper talking about getting rid of ME, after THE FACT THEY SAY THINGS ARE OK and I do not have any more money that would be a problem. I wanted to leave now, and let nothing else be said, because I felt like this could get ugly. ) THIS LL said Gurl be quiet, u aint going to move no were. You will be fine. Your fine. Do not worry about it. I will call and get things taken care of. This LL did say if you are going to be late on your rent than you should write a note and take it up to the rent office and let them know what day YOU would pay UR rent. If it is going to be Monday, before you pay your rent! This LL had saw that the 20th is on a Sat. Well Praise God. I was tickled. lol On the 17, I went to the city I want to move to, to find a place… lol Never really had money to do things like that, but that just give me a push. The LL Company is not together, as a team… and I cannot play with members that are not team players. I need to find me a place and do it fast. Therefore, I visited sum apt in the city I wanted to move too. On the 18th, I paid the rent and I drop the chargers. I went to the station, ask to drop the chargers, they could not seem to find it. lol But they saw where I had filed it. They did not know if the prosecutor had it or if they had not sent it yet… I guess… something I do not know. The police give me a sheet of paper with the complaint on it to sign it. The police asked me for my name and to state why, I wanted to drop the chargers. THE POLICE told me what to write, after I asked what to write, that I did not want to purse the chargers. I would be moving to another town. I was planning to move after they told me that I would not be able to get an agreement on June 8. I did not know what to do. I had not lost that feeling on moving to another city. The police told me to sign my name and put my cell number. I did. I left. Next, I went to the rent office, the asst manager was there. THE ASSISTANT MANAGER said nothing. THE ASSISTANT MANAGER took my money order, than gives me a receipt. I left. Done. Today June 22, the manager came over to my home asked me have I spoken with the LL that cuss me out. I told THE MANAGER no. I said, “I drop the chargers.”(I know right. I should have let THE MANAGER say, did you drop the chargers, but I was out of suing mode. lol I am going to move in Aug 1 and put up my 30-day notice on July 1. So I was not worried about what THE MANAGER had to say.) THE MANAGER said oh u drop them...? I said yea. THE MANAGER asked me twice. Maybe three times she asked me. WHILE I was explainING what I done to drop the chargers, the manager said, “DO you HAVE A COPY?” DO YOU HAVE A COPY? I said uhhh no I do not have a copy. THE MANAGER said could u get a copy. I said sure, if they make copies. (Oh, I forget to tell you what happen when I filed the chargers. I had to wait a while they asked me what happen. I explain what happen and than I left. They cont. to say that this is a civil matter and that I need to go to court.) They just wanted to know what the LL did to me. I told them what happen. I left. After I left I spoke WITH a lawyer in my city. He told me to file chargers and keep them. He said the LL could not say stuff like that to people. He said that as long as I signed the report at the police station that they will take care of the LL. I said, “Signed what?” I DIDNT SIGN THE REPORT. I had to go back to the station. The captain was there. (He came to the scene when I called the police. He also said that this is a civil matter and this is their private property. OK lol so while I am waiting to find out whom to speak with about signing the paper. The captain says, WHY DIDNT YOU SIGN THE PAPER. I said, “I did not know I was supposed to sign the paper.” He made a sound. I sat about 45mins. The person who done the paper was on an accident scene. So when he got their. He had lost the paper. lol so WHEN HE FINALLY GOT THERE he did another one out. I signed it and left. They had to make me wait because they could not find it, and it had to look like he had it.so I had to wait until he got there.lol but we done a new one. He asked me question over again. I live in a small town. O yea the manager is married to a police. He/she is a nice person. We just saw each other the wrong day. This all happen the day THE LL cussed ME out. Pray for me. Back to the conversation with the manager today, The manager said “well, the LL THAT CUSSED ME OUT said that if you don’t drop the chargers that the LL COMPANY would have to terminated MY lease on Friday JUNE 26, and that I need to get in touch with the LL that cuss me out by Thursday JUNE 25.” I said, “I signed the police report.” the manager said, “ok well get a copy.” THE MANAGER left. The manager did say call the LL THAT CUSSED ME OUT. THE LL COMPANY did no answer. Next, I called the police department for more info. I asked to speak with the person that had helped me drop the chargers. That person was not there. Therefore, I called the manager back and told THE MANAGER that the person who helped me drop the chargers was not in and that I would go to the station tomorrow to get a copy. I told the manager I do not understand why I would have to move. I sold my truck just to stay. THE MANAGER said, “What. Why you do that.” I SAID, “Uhhhhhh. I had to have my rent by the 20th.” I told the manager that my truck was still in our complex and at what I sold the truck for it. The manager said, “well, just come on over to the office tomorrow and write out something saying you drop the chargers.” I Said, “Ok“. THE MANAGER said, “You still need to speak with THE LL THAT CUSSED me OUT.” I said, “OK“. I hung up. Now what should I do? Should I pack? Do I have a case? What would you do? I am lost. They were wrong. I do not mess with anyone. I am only trying to make it. I am not like a lot of other people and I do not want to be treating like this. I want to go to trial. Can I go to trial? First of all, WAY too much drama here.

1) Why did you think it was more important to have your daughter's birthday party than pay your rent? The management would probably have been more reasonable if they hadn't seen that, and at least you could have made a good faith payment towards rent with what you saved instead of wasting it on a birthday party. You could always reschedule that party when you could afford it! Where are your priorities???

2) When the LL said they were terminating the lease, it still gives you time to move afterwards. They must give you written notice of their intent to terminate, not just tell you. You didn't say what state you were in, but 30 days advance written notice to vacate is standard for most states. They can't just toss your stuff out - that's illegal. They must use the court's legal process to remove you.

I think that this entire thing could have been prevented with more communication and less drama. If you want to leave, maybe you should. Find another LL who wants to deal with your drama.

HI. Sry this seemed like drama. It really is. I dont think its drama on my end.
First, The LL didnt c my party, or anyone. It was in my home. This all took place around 430pm that evening. Maybe 5. Thats why I couldnt speak with anyone at the LL COMPANY. I didnt spend any money for her party. We had cake, hotdogs, and drinks. I get food stamps. I live in Arkansas. The cake was already order weeks before the party date. I didnt have to pay a cent of my pocket. I am on a fixed income because of my daughter illness. Remember, Ive never been late. They didnt even know I had a party. ONly u all. The party started after, I left the rent office with my mother. She came over for the party. I am only asking, should I sign the paper stating that I drop the chargers at the REnt office, or I can go to the station and get a report from them. But cont. to remember, I dont have the copy of the report. I just signed something with my name on it when I went back to drop the chargers, and when i went to sign the form because I didnt sign it the first time. Do you really think this is all my fault. I mean I have never ever been late in 3 yrs. I had my stuff together. I really got behind. I am sry for that. But I dont think they should have went off on me. I went into details about what happen to let you know what I was feeling. NOt to show drama. Ive always done my part. If they come back to my home Thursday with evition papers, when do I have to leave. I cant right now, it would be really hard. And if they make me leave, without the proper notice. I think they should help pay for me to leave. What do u think? Please help me, dont be agasint me.

I don't fault you for having a b-day party for your child. A small party for a child's b-day would be expected. However, you should know a couple of things.

Your rent was due on the 1st. The date on the 5th was NOT the late date, nor the due date. It was late on the 2nd! The date on the 5th is when the grace period ends that they gave you to not have to pay the late fees. So if you paid your rent after the 1st, you had been paying late. You just paid it before the fees kicked in, that's all. Paying after the 1st is late.

If you knew you didn't have the rent, the right thing to do is to contact the office BEFORE your rent is due and let them know. Like everyone else, they have bills to pay and must make plans to be able to pay them. When you don't tell them, they are counting on your rent to pay those mortgages, insurance, taxes, repairs, etc. Always let them know in advance if your rent will be paid afte the 1st. Rent may be paid on Saturday, or even Sunday if that is when it is due. Most offices have a slot or drop box to pay on those dates. If no box and you know your rent wil be due on the weekend, pay on the Friday before. Your MO receipt can act as your receipt.

The drama with your the LL is too much. When the manager told you no extension would be granted, that was that. You should have accepted it. He is the person in charge of the complex. Arguing with the LL over the rent you haven't paid isn't smart. Being apologetic for not paying what you agreed to pay on the date you agreed to pay it is a much better tone. Then trying to file charges on the LL for being angry that you didn't meet your obligations? Yeah, he shouldn't cuss at you. But filing charges will get you no where but evicted for non-payment.

What it boils down to is this. If you have a lease, expect to honor that lease until it ends. Then give the required amount of notice for your state and move. If you leave before the lease ends, expect consequences.

Oh, and I forgot to say:

If you need repairs, write a request for those repairs to be done. Don't just tell someone. Put it in writing. Date it. Keep a copy. Telling someone is an easy way to have your repair forgotten about, especially in a complex with many other units. And it doesn't prove you ever asked for it to be done. Put it in writing, always!

Hi, Yes.. when it all boils down your right. I shouldnt have said anything else... but I just guess since, I hadnt never asked for help, maybe I could get it. That was my fault. YOu live and you learn. I am a young woman. This is my 2nd apt. Thats not an excuse.. but I just felt like they would give me a chance. I didnt expect to be talk to rudely. Ive dropped all chargers. Paid my rent. I am also planning to move. They dont have funds at this moment to move me or to fix my apt. I need to move closer to a major city for my child anyway. Thanks for the advice...
