Confused Squatters of sorts...

My ex and I are in the middle of a divorce... our house was put up for sale and both of us moved out of it... him first than me... it is behind on payments with the mortgage company... meanwhile... he since recently moved back in, changed the locks, denied me access, and allowed his girlfriend and her husband to move in... and now his girlfriend's sister and her daughter... He is denying the realtor access as well, and no longer wants to see despite signing the realtor agreement...

How can I get at the very least the extra people out of the house? I know I cannot evict him as we are both on the lease, but I would like to know if I have legal grounds to ask the others to move out and to get access myself to allow the realtor to come in... Please advise. Thank you in advance for your help.

Sorry to hear about your situation. Since you are both on the lease, as you mentioned this will not be a simple eviction. The police will probably say it is a civil matter and refuse to get involved. Really, the only thing to do is get a lawyer so the matter of the house can be addressed by temporary orders. WLD has family law attorneys -- you should go through their main site and contact them. Hope it works out! AJJ

I agree. You will not be able to remove these others since they are his guests. The best you can do is to petition the sale of the house as part of the divorce settlement and get a court to order him to cooperate with the sale.
