Unhappy Family members - eviction (Florida)

I live in Florida, Duval county: My son , common-law wife and daughter have lived in my home for approx. 7 years. We share home , no rent agreement .They pay electric bill ,I pay mortgage. My son takes care of yard work, and home maintenence, (labor only )
Things have become intolarable between his woman and myself, and I have told her to get out of my home. She states that as she has been a resident in the home for 7 years I have to serve an eviction notice on her and she will have 90 days after that to get out.

Do I have to serve notice on her 11 year old daughter too ? or just my son and her
or just her and her daughter is automatically included ???

Florida EVICTION

Adults tenants over 18 must be notified separately.

Floridas' Landlord/Tenant Law


* The eviction notice is the landlord's request or formal demand made to the
tenant. It asks the tenant to move out. It is delivered to the tenant only, and
is not filed in court.

* If the tenant does not voluntarily move as requested by the eviction notice, the
landlord may file an eviction case in court. The eviction case is the landlord's
request or formal demand made to the County Court. It asks the Court to evict
the tenant.

* The request is made in a Summons and Complaint, which is delivered to the
tenant by a process server.

* The tenant has five business days to file a written answer to the Summons and
Complaint or he/she will be evicted.

thank you, hopefully it will not take long for the courts to do their due process.

Rather sad . that it has had to come to this state off affairs, But enogh is enough .

You can't file for eviction until you have given them a written 15 day request to move out and they fail to do so. You have to do it in writing first. Keep a copy. Then file for eviction if they don't leave. Sorry things have gotten so bad between family members.
