Someone Help
I have three children and a fourth child staying with me this summer. We own a three bedroom wich basement was flooded 50 days ago. My wife and I cant go on with this. All our stuff from downstairs is up and it is very crowded on the main level. I have came home with stray cats in my bedroom and my back door completly open all the time. My wife is pregnant with our fifth child and she is beginning to stressout and Im starting to worry about her. Its hot upstairs because it is a townhome and the AC doesnt work well. Its crowded what do I do. We also have Mice now, We are both in the military but we dont have money to pay for another home and the penalty for breaking our least. I put in my 30 day so I guess we will have to wait and see.

How does your overcrowding, and the door being left open, have anything to do with your LL? Sell or donate some goods away and tell the kids to close the door.
As for the mice and the A/C, write a letter to the LL and ask for immediate repairs. Send it certified, rrr, and keep a copy. If he fails to respond, you may have other legal options (like rent withholding or repair and deduct remedies). But I need to know your state to see what is legal there. If this is a single family house, you are probably responsible for the extermination. If it is a multi-family property, the LL is responsible. What was the cause of the flooding? Was it something the LL failed to do (like fix a sump pump or correct a foundation leak) or something considered an act of God (like a torrential rain storm or a flood)? The LL is responsible for the first, you renter's insurance would cover you for the second. If this can be fixed by something the LL can repair, include that in your letter. Unless you have provided the LL with written notice to repair and given him time to do so, you will not be allowed out of the lease without consequences. Normal consequences include owing rent until it is re-rented, advertising fees, agent fees to find a new tenant, any unpaid utilities that would be liened against the owner, any other unreimbursed costs the LL has because of your lease break, and damages to the house. |
