Cool increasing number of tenant

I have some questions about the number of tenant and the rent. I shared a room in a house with 3 bedrooms, 1 bathroom, a living room and a kitchen. There are 4 persons living there including me. Every month I’ll give the rent to another roommate, Jane, who collects all the rent from each roommate and send to landlord. We don’t have any contract, just pay month by month. I had the argument with Jane. Because she let a girl rent the living room space. (5 people living in the house) When I asked Jane how much the new girl pay for the rent and how much I suppose to get the discount. She refused to answer my question and said it wasn’t my business. …..I’m so disappointed with Jane. I know the new girl will give Jane the rent. (I think Jane will give just a few amounts to the LL) She will take the big piece for her.

I feel like I was treated unfair. Also Jane is taking advantage from us. In this case Jane has the right to do so? Can I ask for the new appropriate rent?

You agreed to rent with the number of people that were there. So you can complain but if you have no lease they could ask you to leave after 30 days.

My guess is that Jane is the Master Tenant (the one on the lease) and that you sublet from her. As such, your agreement is with Jane and not with management. Your agreement is for the amount of rent that you agreed to pay her, not a fair share of the rent being charged Jane or per person. Jane, as master tenant, can charge you what she likes for the rent as long as you agree to pay it. No law says she must divide the rent equally between people or not make a profit.

As for the number of people allowed to live in a house or apartment, HUD (Housing & Urban Development) allows 2 per bedroom plus one. Your 3 bedroom house could legally be rented to 7 people. Not what you want to hear, but this is legal.

If you don't like the agreement with Jane for renting your room, the solution is simple. You have no contract and only have to give Jane the amount of written notice to vacate as required in your area. Then clean your room and return the keys prior to the end date.
