I gave my tenants a 7 day notice to vacate (incurable non-compliance) on April 11. Naturally, they do not understand that I am tired of all the cr*p I have been putting up with. They don't know why I want them out, because, after all they pay their rent. They said they were not moving out until the end of the month because they were paid until the end of the month. After a delay because of a problem with the paralegal I had hired, I finally did the paperwork myself. They were served on May 12. I checked the clerk of court website and found they answered it on May 15. How do I find out if they deposited the rent w/ the court (they did not offer any rent for May - I was not going to take it if they did)? I could not find it on the clerk's website. Also, should I receive something telling me this has been done? Should I get an attorney at this point or is this something I can take care of? Their lease was up Oct 31, 2008. I did not renew the lease, left them month to month.

Call the clerk of the court and they will inform you.

The clerk should tell you if rent was deposited with her. Beware of their answer. It is a delaying action. What was the non-curable violation?

The non-curable violations are: 1)second broken window due to fight; 2)more than 4 persons living there (second violation); 3)pets (second violation); 4) drug activity; 5)average of one police call to property every 2 weeks. I called the clerks office. They did not deposit any rent into an account. The Clerk of Courts has laid off a fair amount of staff, so I was told it would be at least 30 days before the judge sees the paper work. The tenants have moved out most of their stuff, but their son keeps coming back with friends and doing who knows what in there. The carpet has numerous burn holes in it, the tile in the hall bath is burned. They could burn the place down before we get to court. It has been raining like heck here. I went by the place last week and found no one home and the front window open, soaking the carpet. Today I went by there and found the back door wide open and no one around. The front door locks have been changed, but I can still get in the back door.
