A few years ago, I rented a duplex with two other people. We always paid our rent, but the landlord obviously wasn't making the mortgage payment. The actual owner was his ex-wife, but he was collecting the rent. Well, come to find out, the house was going up for auction and the attorney's or firm who was handling the foreclosure sent us an unlawful detainer, even though we always paid our rent. I don't feel that I was treated fairly. I believe the company who purchased the house at the auction was going to restore/remodel and fix up the house and didn't want any tenants living there while the construction was being done, thus the unlawful detainer. My question is this--Is there a way to expunge this without having to pay a huge fee in advance? It seems so unfair that I have this on my civil record now and it's been hard to find a place to rent unless I am lucky enough to find a rental agent who doesn't simply go by what is on the record, but allows me to explain it and believes me. I have no idea where the former landlord lives and have no proof that I was paying my rent since the landlord disappeared and just let the house go as long as possible all the while collecting our rent payments. Any help would be greatly appreciated. Thank you.

What was the reason for the eviction? (There are other reasons for eviction besides non-payment of rent.) Were you asked to vacate and did not? Did you violate some portion of your lease? Did you have a lease? Were you given notice of the eviction? And if so, did you attend the hearing? More info is needed. If you don't know the answers, get a copy of the eviction transcript from the clerk of court and read it. Then re-post here and we can give you answers of how to possibly get this dismissed.

I agree there is a process for each state (yours is yet to be named) however it never "begins" with unlawful detainer. There must be more to story you left out
