By the way, for any one that would like to know the law in Texas... Let me tell you about precedence. In almost every state of this GREAT country of ours, precedence rules verses contracts and even state law. For example; if a landlord were to accept rent from a tenant on the 20th every month for 6 months or more without charging late fees shows precedence. No longer could the LL ask for prior late charges if at court with the tenant. Precedence was set and therefore is the new binding contract. The LL must by Texas law send the tenant a certified letter notifying the tenant that verbal or email requests are no longer acceptable five (5) days in advance before charging late fees. Any prior late fees are history!

Am I wrong?
