I need help terminating a lease on my house in Virginia. We currently live out of state. After 18 months of our house being on the market, we finally decided to rent it out. Our renters returned the signed lease Fri, Apr 24. The lease starts this Fri, May 1, 2009 and runs through May 1, 2010. We have not cashed their check for the first month's rent and security deposit yet. On Sat, Apr 25, I contacted our renters about breaking our lease; I found out the night prior that my husband is moving out and we are separating. I want to take my children back to our home in VA. We used a standard lease agreement from legalzoom.com. As I read it, I don't see anything about early termination. I have offered to pay our renters $1000 for their time and suffering and pay for their deposit on their movers, but as of now, they are not willing. Is there anything I can do? After Jun 30, 2009, I have no where to go. Any help you can provide is MUCH APPRECIATED!

There isn't much you can do. You have a legal signed lease with the tenants. Whether you cashed their check or not, they have submitted the correct payment to you. If I were you, I'd explain the situation to them and rely on their good sense to move out. You may have to sweeten the pot and offer them more than the $1000 to get them to move. You might offer to pay an agent to find them another place, moving expenses, or some other incentive. If they refuse, all you can do is wait until their lease runs out then non-renew. You can't force them to terminate. You will have to find somewhere else to move to. Remember to ask your soon to be ex-husband to pay for some of your housing costs since he agreed to rent out this house although he knew he was going to seperate with you.
