Question lWhat does VA law say about renter subletting?

Virginia - Question from a landlord: Our lease agreement states that subrenting is not permitted. It came to our attention that the renter might be renting out the basement to another person. Do they have any legal right in VA to do so despite the lease stating otherwise? If we were to consider to allow it, what steps do we need to take to protect ourselves? If the renters move out or in case we have to evict them, does the'subrenting' person by law have to leave to? Thank you.

If your lease prohibits subletting, the tenant nmay not do so. He is in violation of his lease.

He may also be violating state and city building code. Does the basement meet building code for habitable space? Does it have the correct forms of egress, windows in bedrooms, fire alarms and/or sprinklers? How about heat? If not, you could be cited for allowing someone to live in this space.

I suggest you give notice to inspect now. Go inspect and see if someone is living there. If so, give notice of the violation to your tenant immediately. Require that this person move out of the basement.

If you have to go so far as to evict the tenant, make sure you list all of the eviction paperwork in the names of "Joe Tenant And All Others" to be sure the occupant must leave with the tenant. If the tenant moves out and leaves you with the occupant, file against the tenant as above. It is the tenant's responsibility to remove this person since he brought him into the unit. That tenant has not vacated the unit if someone is still living in it.
