Confused Month to month lease Florida

Hi,

My husband and I currently rent a home on a month to month lease in Florida. We have lived in this house for 5 years and when we first moved in we had a standard year lease. We paid first, last, security, and an additional pet deposit when we moved in. We have been on a month to month lease for the last 3 or 4 years and now want to move. So, with the first of the month coming up we want to let our land lord know our intentions (which is to be out by the end of next month). My question is: do we have to pay this month, which is our last month?

Any advice/help will be greatly appreciated!

After reading through some older threads I thought it noteworthy to mention that the LL told my husband that he has spent all of our deposits ans that we never received any Escrow info...

Hi,

OP here. I see that I need to give 15 days notice, but what about my prepaid last month? We want to be out by the end of April, so I need to send notice right away. I guess my question is, do I need to pay this month? My LL lives very close to me, I planned walking to his house and talking about the move (and yes, I will send written notice!).

Yes, send written notice of your intent to move out now. State that you will be using your prepaid last month's rent for April as permitted by your original agreement. Give the date and time that you will return your keys, and give your forwarding address in writing. Let your LL know that you want your deposit forwarded to this new address within your state's time limit. If she fails to do so, you can file against her in small claims court for the money. If she spent the money, she will now have to borrow some to pay your deposit back.
