Does Indiana law only require a tenant to give 30 days notice of intent to vacate when lease calls for 60 days?
My lease recently expired and, pursuant to the lease, I have been paying a month to month fee (rent plus an additional $40). My lease states that I can live at my apt month to month, but I still need to give them a 60 day notice of intent to vacate. Once I give notice, and then pay the 2 months rent, I can move and owe no additional money. I have heard that Indiana law only requires a 30 day notice of intent to vacate when one is on a month to month lease, and that I am only responsible for 30 days rent. Does Indiana law have such a provision, and does this provision supercede my lease? If I give a 30 days notice, am I only obligated to pay for 30 days? |

IN Code 32-31-1-1 and 32-31-5-4 cover month to month tenancies. You need only give 30 days nmotice to vacate on a month to month per IN law.
