Hollywood Florida Non-payment of Rent
Hey to every body,
I'm a landlord of a house which I rent in the city of Hollywood, Florida. I'm renting my house to a lady which is refusing to pay the rent of February, The collect day for rent is every mount on the 1st, for the same month. I give the lady a call on the 25th of Jan and asked her if I will be able to get the rent money on the 1st as usual, she said she won't have the money until the 10th of February. According to the rent agreement we made, she has 5 grace days to pay the rent, so I just waited 5 days and I thought she will pay me the rent money. Today is the 11th of February, and unfortunately she didn't pay the rent money.. She don't pick up any of my calls, she don't answer when I'm Knocking on the door and waiting for hours outside the house, although she is inside the house knowing I'm out side. I was looking all over the web, but I couldn't find any guide for what are the steps that I need to do to vacate the lady from the house, in the right and fastest way according to the city rules. Non-Payment of Rent
Section 83.56(3), F.S. The landlord must serve you, the tenant, a written notice allowing three days (excluding weekends and legal holidays) for you to pay the rent or move from the premises. If you do not pay the rent or move, he/she may begin legal action to evict you. In order for the landlord to gain payment of rent or possession of the dwelling, he/she must file suit in county court. If the court agrees with the landlord, you will be notified in writing. You then have five days (excluding weekends and legal holidays) to respond also in writing to the court. If you do not respond or a judgment is entered against you, the clerk of the county court will issue a Writ of Possession to the sheriff who will notify you that eviction will take place in 24 hours.

thanks for the Fast answer.
1.Can i just mail her the notice? or i have to give her the notice by hand? 2.Can i do all the paper work by my self? or i have to see a Notary? or a lawer?(if so ill be happy to get an Recommendation) 3.Do i need to send a copy of the 3 dyas notice to the court too? 4.If the lady dont respond to any of the above ,How long it can take the court until i get the finel "Writ of Possession" notice? Thanks agine Eric |

You can tape the 3 day pay rent or quit to the door 2.Can i do all the paper work by my self? or i have to see a Notary? or a lawer?(if so ill be happy to get an Recommendation) If the 3 day pay or quit fails I woud suggest you find a Lawyer. You might be able to so it your self (not good idea) but you can ask court clerk how to proceed 3.Do i need to send a copy of the 3 dyas notice to the court too? That woud be good idea in case the tenant claim they didnt get it. Although that wont matter much if rent still has not been paid. 4.If the lady dont respond to any of the above ,How long it can take the court until i get the finel "Writ of Possession" notice? That depends on how busy your courts are

No its not that official. You might even google three pay rent or quit notice. Then print the form
