Default landlord selling home

My house is for sale with the option of owner occupancy, if it were to sell, how many days does the new owner have to allow us to move? Who would be responsible in getting out deposit back?

First off is there a lease agreement? If so the new owner is bound by lease. Now how long to depart depends on your state and how long you have lived there. You might talk to current owner about a "cash for keys" deal. This would hav eyou out of home now with money in your pocket. Its easier to seel an empty home than occupied one

I live in WI and my 1 year lease has expired, I have been here for 5 years. I have a family, so it is hard finding a 3 bdrm home that allow's pets. So the option "cash for keys" wouldn't work. I am hoping someone could point me in the right direction.

Your lease has expired and you are now a month to month tenant or a tenant at will. You can give or recieve 28 days notice to move out. Once sold, the new owner can give you that amount of notice to be out of the unit. Or, you can start looking for a new place now and once you find one that will accept your pets, give your current LL the ntoice to move out.

If you move out prior to the sale, the current owner will refund your deposit. If after the sale, the new owner should receive the deposit at closing from the current one, and should refund it to you within 21 days of vacating. If it appears that a sale is pending, make sure you notify the buyer that you have a deposit of $xxx on file with the current owner and that it needs to be transferred to them at closing. This will prevent any misunderstandings when you move out.
