I LIVE IN MACON GA I HAVE BEEN A TENAT OF MY APARTMENT A LITTLE OVER 3 YEARS NOW I HAVE NEVER HAD ANY COMPLAINTS BUT RECENTLY I HAVE EXPERINCED ALOT OF HARRASMENT FROM THE LL. I LIVE IN A BAD NEIGHBORHOOD DRUG USERS AND ADDICTS ARE ALL AROUND BUT THEY DONT BOTHER ME I HAVE A PARALYZED BROTHER THAT COMES TO MY APARTMENT DAILY SO I CAN HELP HIM WITH HIS ADL'S ( BATHING, BOWEL MOVEMENTS) IM HIS CAREGIVER TO THAT EXTENT. MY BROTHER AND I WERE SITTING ON MY PORCH ONE EVENING AND THE LL DROVE THROUGH THE APARTMENTS HE STOPPED WALKED OVER TO US TOLD MY BROTHER THAT HE WAS TRESSPASSING AND DID WANT HIM THERE BECAUSE HE HAS HEARD THAT HE WAS SELLING DRUGS FROM MY APARTMENT, WHICH IS FALSE THEN HE BROUUGHT ONE OF HIS POLICE FRIENDS OUT AND TOLD HIM THAT HE WANTED MY BROTHER LOCKED UP FOR TRESSPASSING, THE OFFICER DIDNT LOCK HIM UP BUT HE TOOK HIS ID AND GAVE THE LANDLORD MY BROTHER WHO WAS SITTING IN THE WHEELCHAIR NAME AND ADDRESS. THAT OCCURED 12-7-08. THE NEXT INCIDENT OCCURED 12-17-08 IM RECIEVING GOVERNMENT ASST. FOR THE APARTMENT IT HAS FAILED ALL 3 INSPECTIONS DUE TO LL LACK OF REPAIRS, NOW THE APARTMENT IS UNDER ABATEMENT AND THE LL WILL ONLY RECIEVE THE PORTION OF THE RENT THAT I PAY. AROUND 3PM ON 12-17 MY FAMILY AND MYSELF WERE SITTING IN THE LIVING ROOM WATCHING A MOVIE WHEN A THE MATIENCE GUY CAME IN TO LOOK AROUND AT THE REPAIRS THAT NEEDED DONE, HE LEFT AND SAID THAT HE WOULD BE AROUND TOMORROW TO START FIXING THE PROBLEMS ABOUT 15MIN LATER A POLICE OFFICER KNOCKED AT MY DOOR ASKING ABOUT MY COUSINS CAR THAT I USE AS TRANSPORTATION . THE CAR WASNT ILLEGALY PARKED . ALSO SINCE HE RAN THE TAG IT STILL WOULDNT LEAD TO MY ADDRESS BECAUSE IM NOT THE OWNER. THE OFFICER THEN PLACED HIS FOOT IN MY DOOR AND ASKED WHO WERE ALL INSIDE MY APARTMENT. WHICH I SAID THAT IT WAS NONE OF HIS BUSINESS BECAUSE THEIR HADNT BEEN A DISTURBANCE CALL TO MY ADDDRESS AND HE HAD NO WARRANT TO ENTER MY HOME, THE LL WAS STANDING OUT SIDE AND INSTURCTED THE OFFICER TO CHARGE EVERYONE INSIDE MY HOME WITH TRESSPASSING THE OFFICER AND MYSELF HAD WORDS HE USED FORCE AND LOCKED ME UP. I HAVE INTERNAL AFFIAIRS WORKING THE CASE AGAINST THE OFFICER BECAUSE HE CAME TO MY APARTMENT UNDER FALSE PRETENCES, HE ENTERED MY HOME WITHOUT A WARRANT, HE USED FORCE TO LOCK ME UP WHEN I WASNT RESISTING ARESSET, AND HE HAD HIS OWN KIDS IN THE BACK OF THE POLICE CAR DURING THE CALL, HE WAS A FRIEND OF THE LL AND THIS IS THE 2ND TIME THE LL HAS BROUGHT AN OFFICER TO MY DOOR. THE LL FILED AN APPEAL WITH THE GOV. ASST PROGRAM IM IN BECAUSE HE STATED THAT I WAS INCARCERATED BECAUSE I WOULDNT ALLOW THE MATIENCE GUY TO COME IN AND DO REPAIRS TO THE APARTMENT THATS WHY THE APARTMENT FAILED THE LAST INSPECTION. THAT WAS A LIE AND I PROVED IT TO THE PROGRAM BY BRINGING THEM A COPY OF THE POLICE REPORT AND THAT STATED WHILE INSIDE DOING REPAIRS THE MATIENCE MAN TOLD THE LL THAT MY BROTHER WAS INSIDE MY HOME TRESSPASSING ALONG WITH OTHER MALES THEN THE LL CALLED THE POLICE TO MY APARTMENT. NOW, IM NO LAWYER BUT I CAN TELL WHEN A LIE IS BEING TOLD AND THE POLICE REPORT PROVED THAT THE LL WAS LIEING BECAUSE HE STATED THAT I WAS INCARCERATED FOR NOT ALLOWING THE MAITENCE MAN TO COME IN BUT THE POLICE REPORT SAID THE MAITENCE MAN WAS INSIDE WORKING AND NOTICED MY BROTHER IN MY HOME. ON 1-09-09 I HAD TO CALL THE FIREMAN TO COME OUT TO THE APARTMENT BECAUSE THE AIR AND HEATING UNIT STARTED TO SMOKE AND SMELLED LIKE BURNED WIRE NOW THE UNIT DONT WORK ANYMORE. THE FIREM SAW THE CONTROL BOX HAD BURNED AND THE WALL BURNED A LITTLE TO SO THEY ALSO MADE SURE THAT THE MAIN BREAKER BOX WAS TURNED OFF TO PREVENT A FIRE. THAT WAS AROUND 12:30 AM ON THE 9TH I PAGED MATIENCE FOR THE NEXT 2 DAYS AND NO ONE EVER CALLED BACK I HAVE NO HEAT, I HAVE A 2 YEAR OLD INSIDE THE HOME AND IT GETS 32 DEGREES AT NIGHT I ONLY WANT TO COMMUNICATE BY LETTER WITH THE LL BECAUSE I HAVE ALREADY PROVEN THAT HE WILL LIE TO MAKE HIMSELF APPEAR RIGHT , WHAT SHOULD I DO, DO I HAVE A HARRASSMENT CASE BECAUSE THE CASEWORKER AT MY PROGRAM ASST SAID TO CONTACT A LAWYER BECAUSE HE IS HARRASSING ME. AND SINCE MY 2YR OLD SAW HIM BRING THE POLICE TO MY DOOR AND EVERYTHING THAT WENT ON SHE IS AFRAID OF THE POLICE NOW THAT HAS CAUSED ALOT OF EMOTIONAL DISTRESS TO HER

Long thread. First, please turn caps lock off. It makes your post hard to read and in internet ettiquette, it is considered yelling. Thank you.
I can't comment on everything because I have no knowledge of why the police were brought to your door on each occasion, what your brother or friends' criminal histories contain (if anything), or what reports were given to the police to make them think that drugs were present. I also don't know why your unit failed inspections, or how long the problems have been going on. So forgive me if I fail to go over everything. As for your brother, if you do not have him listed as an occupant or guest of yours with the LL, he should not be there everyday. Forgetting his disability for a minute, any tenant that has a person at their home each day is going to get a notice from their LL. Especially if receiving housing assistance, as this program strictly states that no one else may live at your unit while you recieve this assistance payment. Most leases state a limited time that guests may be at your unit. Exceeding a reasonable limit makes it appear as if someone else is living in your unit. This would be in violation of your lease and the housing regulations, and would jeopardize your assistance and his payments for rent. Since you are his caregiver, you need to register that fact with the housing program and your LL so that it will be authorized. Unless you have registered this in writing with both the LL and the housing authority, you will continue to have resistance to this man being there so often. Contact your caseworker for the proper paperwork to have this man listed as your ward. Your LL has the right to have the identity of any person that is in your unit daily, as it appears the person is living there. (He is entitled to know who is living in the unit.) If he is being sighted there daily, the car is there each day and not registered to you, etc. these are indications that someone is living there who should not be there. This is why the police gave your brother's identity to the LL. Get the paperwork straightened out immediately to stop this. I don't know which repairs the LL has not done that allowed your unit to fail inspection. It could be something large or something trivial. This program has huge amounts of regulation associated with it. Your unit could fail inspection for something as simple as a bad battery in the smoke detector, a cracked switch plate, or a little peeling paint on an exterior windowsill. Or it could be something as important as non-functional plumbing. Either way, the LL is not being paid rent until it is repaired. If it is an emergency or habitability repair, such as the new problem with the heater, you can contact the building inspector or the health department about it. They will city the LL and force him to do repairs. It does not sound as if you were cooperating fully with the police officer. If you didn't know if he was on duty, if he was permitted to do what he was doing, or if he had a valid reason to be there, you should have called the station to request another officer be sent. Another officer would have been sent (probably a supervisor) to see that this officer was performing within the scope of the law. You don't try to close the door in the face of a police officer. You cooperate with them and call for backup. You don't know who called the police. It could have been the maintenance man (most likely since you said he had just been there), a neighbor, someone across the street, etc. You don't know for sure. A police officer does not need a warrant to come to your door. If you appear to be uncooperative with them, it only gives them probable cause to investigate further. (It appears you are hiding something.) Open the door and answer questions or state that you want to speak to your attorney. They will stop questioning you. The fact that you tried to close the door and appeared uncooperative is what got you arrested. It is not the officer's fault if he arrived at your door under false pretenses. He doesn't know that. He only knows he received a report. If your caseworker told you to see an attorney, that is what you should do. I can't say if you have a case for harassment against the LL. Sounds to me as if you both are partially at fault here. You have not registered your brother or you as his caretaker to authorize his constant presence at your unit You have not cooperated with the police. The LL is pushing to see who is in the unit and seems to be forceful about it. Someone (you don't know who) is calling police to your unit for unknown reasons. Too many people or visitors to your unit may be giving someone the wrong impression. (Only you now if there is a reason the police are there or not.) I suggest you take steps to clear up this situation and misunderstanding (not considering the lack of repairs) by getting proper notation of the brother in your file. Call the building inspector about the lack of heat to get the repairs done immediately since no one should live without heat. Good luck. Consider moving soon since you have already finished your lease term. |

To the last poster. The advice I gave was state specific for GA. Other states may have laws about close family being allowed to stay with them. NYC for one has a law like this. Please check laws for your area about family residency.
Reports on habitability issues may go to different departments than those listed. Each state/city has their own procedure for reporting these. In various areas, these are reported to code enforcement, the building inspector, HUD, the health department, a local court, or another entity. Please find out who handles these reports in your area. |

I arranged 2 meet with my brother in another place 2 assist him as 4 the LL his matience man is writing a statement proving that the LL is bringing his off duty friends to my apartment because he see a car that im driving internal affairs is investigating the cop cause did know he came 2 my home under false pretencies he didnt say n the report that he approached my door about a car the LL and cop stories didnt match ,

Tipp, you don't need to worry about the LL's and the police officer's stories matching. That is internal affair's problem to discover the truth. All I can say is to wait for internal affairs to finish their review and see what they say. In the meantime, you should consider looking for another place to live. I cannot see you having any peace in this one. ind a new place, give the appropriate amount of n otice, and move to a better place. Good luck.
