are asking to leave the store. They never gave any receipt of the rents given. This store is the only source of the income of my brothers family. What should my brother do?

Default Re: landlord vs tenant

Are they asking him to 1)quit working in the store (firing him or forced retirement) but they are planning on keeping the store open, or 2)are they saying the store can no longer operate in the nursing home (terminating his rental contract)? See the answers for each below.

1)If he is being fired or forced to retire and they plan on keeping the store open, this would fall under labor laws. You would have to repost this under the labor law portion of the website and seach local and national laborlaws to see if he has any protections.

2)This is a commercial rental. If they are terminating his rental agreement and he has no current lease, they can do this. They must give him the required amount of notice for that area (usually 30 days in the US) before he has to leave. Unfortuantely, without a written current lease, he is in a month to month agreement with the owners. They can terminate the agreement at will. His only option would be to reopen the store by renting another unit nearby and moving his inventory there. If he has a current written lease, they may not terminate until the end of the lease term.
