APPARENTLY, in my lease I am supposed to give a sixty day written notice to my apartment complex before moving out, despite the fact that it says the duration of my lease in my contract. I didn't give one and I'm planning to move out on December 31st. My lease states that if I don't provide a notice, I have to pay liquidated damages of one month's rent.
Anybody know if there's anything I can do? Is there a law in FL governing apartment move-out procedures or anything? I think I assumed these were only required for month-to-month leases. |

You do have to give notice to move out, even if under a lease. But you may have a cheaper way out if your lease does not automatically renew for another whole year term and it ends December 31st. Wait out the lease, then give notice to vacate on Jan. 1st. You would then be a month to month tenant with no current lease. FL law allows m2m tenants to give only 15 days notice to vacate. You would only be responsible for 1/2 a month's rent instead of a whole month's. Pay the 1st 1/2 of January's and be out by January 16th.
