if a personbecomes ill and needs a handicapped apartment is this avalid reason to break a lease. Having Dr. reports stating that a handicapped apart. is necessary. Will the person be able to breake the lease and get their deposit back which amounts to $3000.00.

According to the Americans with Disabilities Act, the LL is obligated to allow reasonable accomodations to be made to your unit at your expense to allow you to continue to live in it. Would you still be able to live in your unit if the accomodations were made? (examples: widening doors and entries, replacing fixtures with lower ones, changing door handles, adding grab bars, etc.) Could you live there if you made these changes? If so, you can contact the LL about making reasonable accomodations. You pay for these changes or have an aide organization pay for them. You will need to change the unit back to its original condition when you leave.
If reasonable accomodations cannot be made (you cannot use stairs, the remodelling would be too extensive or impossible to do) the LL has the option to move you to an acceptable unit. If neither can be done, you should be able to break the lease. |
