Default Lease termination in Dallas, TX

To anyone that can post me in the correct direction, thank you.

Backstory; About 5 months ago new neighbors moved into the apartment next to mine. They are generally rude, have no respect for others and like to have fights at all hours of the day and night. I have been been woken up at midnight, 3am, 5am, 6am by them fighting. I have called the management and voice complaints a total of 9 times in the last 2 weeks. It is affecting my sleep which is then affecting my work, as in I have reprimanded for showing up tired. The complex has yet to do anything about it, and it has been such an issue that I have resorted to calling the police and filing complaints with them. This is becoming an extreme nuisance, and I am paying way too much to have to deal with this and to have it affect my career and life this much. Is this a reason to terminate the lease? Thanks again, in advance.

Disturbing the peace and fighting are crimes and you need to call the police about it each time it occurs. Get copies of each police report - make sure one is filed. Once you have several reports, send copies of these to management with a demand to abate the nuisance and ensure your right to the peaceful enjoyment of your unit. Keep a log of each disturbance and send a copy of that too. If the manager then takes action by eviction or giving lease violation notices, you won't be able to terminate. You may only terminate after you have proof of the disturbances (police reports), have notified management of the problem (I suggest you send it certified, rrr, and keep a copy of the letter) and management fails to take action. You must give the LL proof of the disturbance (so it's not your word vs the neighbors) and a chance to remediate the situation before terminating.
