Seperated husband wife - both on lease

3 months ago my deadbeat husband walked out on me and my kids and left me to pay the full rent on my own which I can not afford. Is he still legally responsible to pay half the rent since his name is on the lease?

Both you and your husband are obligated to pay any obligation under the lease. If you don't pay, the LL can sue either of you or both to get the money he is owed. You can also sue your husband to get what he owes (his half of the bills) in small claims court. Is he paying child support? Contact that agency and let them know he has left and is not helping support the kids. I suggest you get an attorney and be legally seperated, even if you are not filing for divorce as this will end his right to enter the unit. Until that is done, he has every legal right to enter the unit as he pleases.

I also suggest that you speak to your LL immediately. Let him know the situation and see if he will allow you to break the lease since you cannot afford to stay on your own. On top of everything else, you don't need an eviction against you. Good luck, hope this all works out.
