Check cashed early results in charges
Found a check from a tenant. When asked he wrote me a note saying that he mistakenly gave us 2 checks for August Rent, and that this check should be used for November rent but not to cash it until the end of the month (Oct). I cashed the check on Oct 19. This resulted in overdraft charges when he wrote subsequent checks. Am I responsibel for those overdraft charges? I am in California.

If you agreed specifically you would not cash it then he could try to get those damages in small claims yes. If he really wants to push it...and take the time etc
