LL wants tenant to leave

Hi I am a live in landlord and I live in California. At the beginning of October I rented out 1 of the rooms in my house. The tenant and I have not sat down and signed the rental agreement yet. This is a month to month situation which I let her know before she moved in. Today I gave her the agreement to go over and sign. She refused to sign stating she had to go over it with her aunt first [who does not live or have anything to do with my household] .I stated that the rules were not negotiable that they would have to be obeyed. I told her if she did not agree to these rules I would have to ask her to leave and that I would write out a 30-day notice for her. She stated that she would be out by the 1st of November.[today is Oct 22]That gives me 9 days to find another tenant Does she have to give me a 30- day notice before she can leave the premisis. If she just picks up and leaves I won't be able to make my rent this month.

She will owe you the rent for 30 days. CA law states that a 30 day notice is required to terminate a month to month agreement. You may subtract the remainder of the 30 days, prorated, from her deposit unless you re-rent the room within that period.
