13 months no rent
We had rented our property while we weretrying to sell the house. The Websters rented in june of 2007 and after finally getting evicted oct. 2008 they are behind 26,000.00 just in rent. how do you go about getting back rent?
the couple now the law very well, they have been doing this kind of stuff for 13 years, and i'm trying to stop them and save the next landlord from a nightmare. we went though 4 evictions and a bankrupty before they finally had to get out. we had to sell our business, a truck, another truck got repoed, our house is well into forclosure, and we had to live with relative while all this was going on we couldnt afford to rent ourselves. we have 3 children 6,4,2 and we are expecting in march. I dont understand how people in there late 50's can get away with this kind of stuff for so long and not feel guilty. |

you went through 4 evictions? of the same tenants? if so WHY? if they got evicted once why let them rent again? and how can they owe so much in back rent when it would show on thier rental history that they got evicted so many times before..i know someone who has one evitction on her rental history and has okay credit and cant get a cheap studio apartment because of the eviction....
also can you clear some of you question up....they;ve been getting away with it for yrs...HOW? it should appear on thier records that they have back rent and stuff... didnt you run background checks and all the necessary things before renting to them... |

I think the poster meant to say that they had 4 HEARING before the tenants were finally evicted. Some courts allow postponements and re-scheduling of hearings based on answers by a tenant to the eviction summons. Tenants in some states can file an answer to a summons of eviction to request a hearing on why they shouldn't be evicted and a postponement of that eviction. Some states allow this to go on for months, but 13 months is way too long. You would have better served to hire an eviction attorney to handle this suit quickly.
You have been scammed by professional tenants. A thorough screening of the applicants before selecting them may have allowed you to screen out this couple and avoid this trouble. Always do a thorough screening of applicants. I'm sure you know that by now though. These types rely on finding LLs who do not thoroughly screen them and therefore accept them at face value. They are no doubt professionals at appearing to be hinest and trustworthy. Most scam artists are. Had you checked their eviction or judgment records, you probably would have seen that they had done this before. By finding LLs who do not do this. they can continue on in this manner, scammin one LL after another. I'm sure your monetary loss is well over any small claims court limit. YOu will have to sue in civil court to get a judgement agaisnt them for the $26k, but I doubt you will ever see any of it. This type is usually not collectible. Sorry. |
