hello, I have a situation in Lee county FLORIDA, my landlord is loosing building to foreclosure, in 30 days there is a sale on county steps, it is advertized in a local paper, I gave him $5000 depozit 2.5 years ago, our lease expire January 09, but he will not be the owner by then. How can I protect myself against loosing depozit, I know he will not give it up volunterely. Thank you for any suggestions. rachael

Good question. First, check your state law to see if any special protections have been enacted in the case of foreclosure. Some states are giving tenants special rights when their rental property if foreclosed on.
If there are none, you will have to sue the LL for the deposit money back. Get a judgement for that amount, then try to garnish his wages or put a lien on his personal residence. |
