Oregon, roommate issue....
My daughter is in college and sharing her apartment on a month to month basis. In the last week her roommate has withheld her property by locking it in her car and physically attacked her when she tried to retrieve it and Has also threatened her. My daughter has had several witnesses to the threats and to the physical attack. This past weekend she was forced to leave the property because her roommate had her sister and several of her sisters friends in for the weekend and told my daughter that she had "better not be there when her sister got there" and that she would be "sorry" if she showed up. My daughter went to her apartment on Friday night with witnesses and retrieved as many of her belongings as she could fit into her car, and left to stay with friends and hasn't gone back. What should she do? What responsibility does she have to the landlord in these circumstances? I know nothing about tenant law or what would constitute a legitimate emergency to vacate her apartment.

As far as the LL, she needs to give the LL appropriate written notice for her state. (PLease list the state of the rental.) She should give notice in writing that she is moving out and pay for the period of notice. Since she has no lease, she should not be obligated after that.
As for the roommate, she needs to call the police on her for the perceived threats and the theft of her belongings. Police would ask for proof of ownership, and then allow her to retive here belonmgings. If she is unable to retrieve them, she can send a written demand for these belongings to the roommmate by certified mail, return receipt requested, and keep a copy of this leter. Ask that they be returned to her within 30 days and list all of the belongings that need to be rreturned. If the roommate fails to return them, the girl can file a small claims court case against the roommmate to either retrieve them or be paid for the value of these belongings. |

Sorry, I didn't notice that OR was in the title. She needs to give the LL 30 days written notice to vacate in that state and pay the rent for that period.
