Hi,
I own/live in my two family house and in my unit I live with my g/f as well as a friend and his g/f. Things are not going well and I plan on asking them to make plans to move out. I am concerned this could lead to a hostile environment and wanted to know my rights. They do pay me rent so I wanted to know if this qualifies them as a tenant meaning I must give them 30 days noticed (I am in MA)? We have nothing in writing and only a verbal agreement. Ideally, I would like to be fair and give them 2 months (60 days), but wanted to know if I could run into trouble if asked them to leave sooner. |

With no written lease, they are considered month to month tenants. In your state, you must give them 30 days notice or the interval between rent payments, whichever is greater, to move out. Give them this notice in writing and keep a copy for your records. Yes, things can be hostile after you give notice. I suggest you explain to the tenants that you both know things aren't going well and that this move would be in everyone's best interests. Everyone would be happier this way. Good luck.
