Default Breaking Lease

HI yes my husband and I tried to break our lease because we were feared for our lives and the apartment complex said we couldn't. So we left the apartment and left the person we were scared of to stay there. Well after 2 months of not living there the water heater broke and house was trashed and no one was living there anymore. Well we got a phone call demanding the money for the place. We tried getting of the lease and we have the collection agency calling and harassing me and my family. What should i do? Do i even have a case?

Default Re: Breaking Lease

I'm not sure I understand and I may need clarification here. You feared for your lives from whom? Did you leave someone in your unit when you left the complex? Was this person also on the lease?

Being afraid is not a legal reason to break a contract such as a lease. You cannot break it for this reason. You can take other legal options, such as obtaining a restraining order to have the person removed from your premises if you have been threatened.

If you had a lease and left someone in your unit, you are responsible for the lease, the damages, and the removal of that person. It was your unit and your responsibility to return the unit to management in the same condition as you received it, less normal wear & tear. YOu can be sued for these costs.

Please repost and answer the questions in the first paragraph. Also, please give your state and I can give you a more detailed response.
