I had a quick question regarding the landlord's right of entry into my apartment unit. I know that under Virginia law, the landlord has the right to inspect the premises, make agreed upon repairs, provide services, or show the unit to prospective tenants or purchasers.
However, is there a limit to this? The landlord has been doing this at least once a month for the last 3-4 months straight. In addition, the notice I received was for maintenance on filter changes and smoke detector repairs. However, each time the property has entered the unit, no work was done on them. He simply looks around (including peeking inside the bedrooms) inspecting the unit and then leaves. |

There is a limit on this. Most state laws say the LL may not abuse the right a access. However, 3 or 4 entries would probably not be considered abuse. When he next submits notice to enter for the same reason, ask him point blank why he needs to enter since he was to have taken care of that maintenance last month, but he didn't do it. When he comes, only allow him access to the areas he needs to do the stated work. If he says filter change and smoke detector repairs, allow him access to the furnace, but state that he checked the smoke detectors last month and they only need checked every six months or so, and deny him access to those areas. Filters should be changed every month that the furnace or A/C system is used. You can refuse him access to other areas of the rental. He doesn't need to be in those areas for the reason stated on the entry notification. Keep copies of all entry notices, and have a witness there when he comes next time. If he sees that you won't allow this, he may stop and stick to required maintenance tasks.
