EEK! Tree Fell On Car

The tree in the front yard fell on my car and severly damaged it. I do not have renters insurance, but I do have car insurance...liability. Is the landlord responsible for the damage to my car? Doesn't that fall under thier homeowners insurance or something?

If the tree was not cared for properly and should have been trimmed he may be liable yes.

Ask his insurer and yours to review and comment.

Only if the tree was not cared for (ie: if the owner knew there was a problem and neglected to take action) would the property owner be liable. Unless there was clear evidence and the owner knew of a problem with that tree previously, he had no way of knowing that it would fall. Merely failing to trim a tree is not cause for fault. Most trees are not trimmed, yet they do not fall. He had to know of a problem (for instance: he knew the tree was dead, it was damaged or diseased) and failed to take action (negligence) for this to be his problem. You need to carry renter's insurance and auto insurance to cover your own belongings in case of an accident. Contact your insurer. And call about getting renter's insurance today. If there is a fire, flood, or some other incident at your unit that is not his fault, his insurance only covers his property - not yours. You need to be insured. Rental insurance is cheap - less than $30 a month. Get some to protect yourself.
