Angry Break Lease in Texas

My apartment complex states no pit bulls are allowed however another tenant has a pit bull on the complex which has attacked my neighbors dog as well as almost attacked another tenant.

The complex investigated and said the tenant stated it was not their dog and that they were watching the dog for a friend. However I have seen the dog since that incident.

I have a dog of my own and I am worried about my safety as well as my dogs safety because this pit bull is not kept on a leash. Therefore I wanted to break my lease and move. Can I legally break my lease?

You cannot break your lease yet as you have not referred this to management for resolution. Yu need to write a complaint to management stating that this dog violates the no pit bull rule, that the dog is still in the complex (and that you don't care if he's just watching it - it shouldn't be there period). Additionally, give detals of the attack on another dog, the attempted attack on the person (proving vicious nature of the animal), and the fact that it is not leashed as per state leash laws. State that you want the anilam removed from the complex or you will hold them responsible if the anuimal attacks again. Send this notice by cetrified mail, rrr, and keep a copy. In the letter ask for resolution within 30 days.

Also, call the police annd/or animal control and consult with them on what can be done to an animal who has already attacked once.
