We have a tenant who argues with the manager, assistant manager, and landlord everytime he's told to stop blocking the driveway and fire lane with his weekly yard sales. This in in Ca. We have a law on the books that states that any tenant can have two yard sales a year, only with written permission from the landlord. He was informed of this, buy the landlord last week, and he still defies that authority. I would like to know our recourse in this matter, please. Man's getting on my last nerve, and I'm the manager.

Send him notice of lease violation with a warning that the police will be called if he violates it again. Call the fire marshall about him blocking a fire exit lane. Have him fined by the city department that issues yard sales permits. Or serve him a Cure or Quit notice telling him he can have no more yard sales this year and must get written permission prior to having one next year or you will come close it down by standing there and sending all customers away. Do not renew this tenant's lease.
Additionally, start calling the police each time he argues with authority. A coupple of police calls, and you can evict him for disturbing the peace. |
