Landlord has not returned deposit

My landlord has had 4 weeks to return my security deposit or give me a list of deductions and the remainder and I still havent got anything. I have written him 2 letters now and he responded stating that he was getting estimates because he was going to charge me for the rug to be replaced. That was 3 weeks ago. The state of Vermont law states a landlord has 2 weeks, and he has now had 4 weeks. What should I do?

Ask him in writing for payment today, and file in small claims ASAP.

He will likely pay immediately; if not take him to court.

Send that letter to him certified, rrr, and keep a copy. This will prove he got it. Make sure you put your new address in it (again), since some states say he isn't responsible to return a deposit without this in writing. (You want to end any defense he has against not paying you.) In the letter give him only 10 days to respond. Then file with small claims.
