OK, I don't understand a couple things. Why would you need an A/C for the next 10 months? Summer is almost over - after a couple more weeks, you won't need it again until at least next June. Your lease should be almost over by then, right?
Why would an electrician look over an HVAC unit? Why wasn't an HVAC repairman sent? The electrician can only say it has the proper power, not that it is working correctly or is operating within the correct limits. Ask for an HVAC repairman to come. Send written notice that it is not operating properly and request HVAC service, not electrical service since the unit has proper power. It needs to be checked for condensor operation, fan operation, correct amounts of coolant and ductwork - and elctrician can't check these. Mail this notice certified, rrr, and keep a copy. If the LL doesn't respond within a month, call your own HVAC guy to come and give you a free repair estimate. That guy will be able to tell you if it needs repair or not. It may not be free, but may cost you about $80. Still if he finds something wrong, you may be able to use repair and deduct remedies (depending on your state and its laws) to subtract this from your rent. Finally I am confused on the terms you use. You complain about the A/C unit being too noisy, then talk of the loud heater unit in the BD. Normally, these are 2 separate units (the furnace inside, with the A/C compressor outside on the ground or in an attic). Please explain. |

I just moved into a new apartment 2 months ago. Before we moved in we told the landlord that the air conditioner unit was very loud and that we wanted it fixed. We put it on paper that this was a problem and needed to be addressed. The air conditioner unit is in the master bedroom and is so loud that we are not able to sleep when it runs. The landlord said she would have an "repair man" come and look at it. He did and all he did was put tape on it and said its old and we have to live with it.
Do I have a leg to stand on to get out of this lease? Or am I stuck with this air conditioner that is loud as hell for the next 10 months. Any help would be greatly appreciated. Thank you. |

The ac is very loud and they said they would fix it before we moved in. its still not fixed can this void the contract?

While today is a little warm (forecast for 87 degrees), the next five days will not go above 80 degrees. You should not need the A/C for that period. We are already into September and you will not need the A/C after this month at all in PA. You have, at most, a couple of weeks of this problem.
A verbal promise to replace something cannot be upheld in court. You should have gotten it in writing that the noise would be abated. The repairman - was he HVAC certified? Did you ask for his qualifications? Was it a company who came, or his handyman? If a certifed HVAC guy said the A/C unit was working within specs, but is just old (new ones are so much quieter), there is nothing you can do. The unit does not require repair. It is in the same condition as it was when you rented the unit. Did you check the A/C when you viewed the unit? You had the opportunity to check it out at that time and accept or reject it. This is not reason to break your lease without consequences. |
