Occupant release form?
My friend is trying to get off a lease with her now ex/bf that she is not a holder of, merely an occupant so that she can move into another unit on the opposite side of the complex. They say that she and her ex have to sign an "occupant release form" in order for her to apply for another unit and he is refusing to sign it. Is that legal? what can she do?

She can petition the court to require he sign a release form for her. But that is a drastic step!
Probably a better idea is if she can get the LL to send him a letter stating since "he is the only one on the lease, that he alone is responsible for the rent regardless. And that by failing to sign the occupant release form, the ex-GF still will have every legal right to enter his unit and reside there. There will be no legal way to change locks, and that since she has been a resident and still has legal rights, any police officer would allow her entry into the unit. To secure his belongings, it would be smart to end her resident's rights by signing a release to the unit for her." This should give him the wake up call he needs. |
