Angry Landlord breaking lease

I have a Five year lease. The landlord is remodeling the master bath and the kitchen. We allowed this because we thought they were doing it for us as it states in our lease. Well the kitchen is almost done and our bedroom and master bath are torn apart. The landlord comes along and tells us that we need to move by november 15th because they are being kicked out of there place. Breaking the lease is fine with me because the place cost more for utilities than its worth. But there are many financial burdens we are going through now. I would like to know what we can get for our inconvenience and the cost of moving. we made this our home because we thought it was a long term deal. we even got a dog from an animal rescue that will be hard to place at a new house.

First off, a 5 year lease is not legal in most states. Anything over 3 is usually not allowed (many allow no more than 2 years). So the vailidity of your lease comes into play immediately. It may not be considered a valid lease since the term is way too long. An attorney would have to review it to see if it is legal in your area to be that long.

Next, you have 2 options. You can terminate with no further obligation as the LL wants you to do. If so, get a letter stating that you have no further obligation under the terms of your lease. You can negotiate any amount the LL agrees with for the inconvenience. If he doesn't agree to pay you anything, then you have option 2.

Option 2 is to stay put. Don't move. Put up with the mess and inconvenience of the remodelling. Continue to pay the rent and the high utilities until the end of the lease. (I'm sure this will be the only time he offers to let you break the lease early without penalty.) Then give proper notice and move at that time.
