Default CA Pet Fee WWYD ???

A little over a month ago we allowed out tenants to have a large dog. We charged a $300 non-refundable pet fee. The dog has been in the house. Now, they have decided to end their lease early (we gave them the option due to some septic issues) although they didn't have to.

We aren't planning on refunding this pet fee since the dog was in the house, it was a young dog, therefore it's possible that it has peed/pooped in the house and their will be the need to remove pet hair from the carpet professionally.

Would you refund the fee since the stay ended up being so short?

If it was your fault that the leaase ended then I would suggest you keep only a pro rata portion of the deposit, ie just part for the time they were there.

Otherwise you can keep it all.

The fee was non-refundable. However, if you want to be nice, you can refund a portion of it with the deposit statement IF there are no pet damages. If pet damages exist, do not refund and use it to repair.
