I recently was approved for a home I was interested in renting and had an appointment to sign the lease today. I was called by the leasing agent this morning and informed that the owner is having some concerns now about renting to me. My daughter leases through the same company and she is in the process of getting evicted. I believe the leasing agent infomed the owner of this even though my daughter has nothing to do with me and my situation. She will not be living with me and I made that perfectly clear to the agent. After all of this she informed the owner of the property about my daughter and the issues they have had with her. Can this legally be done? My daughter is living with her boyfriend now. I dont think they can legally inform the owner of the issues with my daughter when it has nothing to do with me.

It is not illegal if true.
But the owner normally should not deny you for that reason alone But he has great discretion to approve or deny unfortunately. |

How do you know the rental agent informed the LL of any relationship? You don't. How do you know this is why he has concerns about renting to you? You don't. You only know that he no longer wants to rent to you. The fact that your daughter is being evicted from this company may, or may not, have any bearing on this. The fact that you stated that she won't live with you after the eviction may, or may not, be believed.
The fact is that you have not signed any lease obligating them to rent to you. They have chosen not to rent to you now for whatever reason. Start looking for another place. Any of the reasons above which may have used to deny you are not discrimination and are not illegal. |
